JPMorgan Based Foreclosures on Faulty Documents, Lawyers Claim

JPMorgan Chase & Co. faces a legal challenge next month that could cast doubt on thousands of foreclosures after a mortgage executive at the bank said she didn’t verify documents used to justify home seizures.

Lawyers for a Palm Beach County, Florida, homeowner asked a judge to throw out a foreclosure as a penalty for misleading the court, according to attorney Tom Ice of Ice Legal PA. They’re citing a May 17 deposition in which the JPMorgan executive said she signed thousands of affidavits and documents supporting the New York-based bank’s claims without personally checking loan records. The court is scheduled to hear arguments Oct. 19.

The Chase Home Finance operation supervisor, Beth Ann Cottrell, said in May she was among eight managers who together sign about 18,000 documents a month, according to a transcript of her sworn deposition provided by Ice. Asked how they were prepared, she said she relied on other people at the firm.

“My review is more or less signing the document unless it’s questionable,” she said. That means, “somebody has a question and brings it to me and says, ‘Beth, can you take a look at this?’”

Inaccurate statements by banks in foreclosure documents may give borrowers who have lost their homes a legal basis to challenge the seizures, derailing resales and casting doubts on property titles. A Florida court sanctioned Ally Financial Inc.’s GMAC Mortgage unit for faulty affidavits in 2006, and the firm suspended evictions in 23 states this month after finding employees still signing affidavits without checking the data.

Titles in Doubt

JPMorgan spokesman Tom Kelly declined requests for comment.

Cottrell didn’t return phone calls to her office requesting comment. A lawyer representing her at the deposition, Joseph Mancilla of the Florida Default Law Group PL, didn’t return calls. Cottrell isn’t named as a defendant.

Cottrell signed the affidavit at issue in the case, dated June 2009, while at her previous employer, an outside servicing firm working for JPMorgan, according to court documents. When signing documents there for the JPMorgan unit, she used the title “assistant secretary and vice president” of Chase Home Finance, according to the transcript. She became a JPMorgan employee about three months after signing the affidavit.

Document signers sometimes endorse affidavits on behalf of other firms as a way to streamline the foreclosure process, said Dustin Zacks, an attorney at Ice’s firm.

JPMorgan was the third-largest U.S. servicer of home mortgages as of June 30, with $1.35 trillion or almost 13 percent of the market, according to industry newsletter Inside Mortgage Finance. Ally is the fifth-biggest mortgage servicer, with $349.1 billion. The other three in the top five are Bank of America Corp., Wells Fargo & Co., and Citigroup Inc.

Title Insurers

“I’m sure a lot of title insurance companies are concerned about the potential liability right now,” as borrowers challenge how banks made statements, he said. “The judges could absolutely hold the bank and attorneys in contempt.”

U.S. home seizures reached a record for the third time in five months in August as lenders completed the foreclosure process for thousands of delinquent owners, according to RealtyTrac Inc.

Ice, the founding partner of his foreclosure-defense law firm in Royal Palm Beach, Florida, said some lenders are accepting voluntary dismissal of their cases.

During the deposition, Cottrell said a staff of in-house specialists scrutinize loan documents and prepare affidavits, the transcript shows. If they have difficulties or questions, they come to her. She signs in a notary’s presence, she said.

‘No Knowledge’

During questioning by Ice lawyer Zacks, Cottrell said she had worked at Chase Home Finance for about eight months, according to the transcript.

“As to everything in the affidavit, did you have personal knowledge?” Zacks asked.

“My own personal knowledge, no,” Cottrell answered.

“You stated ‘That plaintiff is entitled to enforce the note and mortgage,’” Zacks said. “Again, did you have personal knowledge of that?”

“No knowledge,” she answered.

Florida Attorney General William McCollum is investigating three law firms that represent loan servicers in foreclosures, and are alleged to have submitted fraudulent documents to the courts, according to an Aug. 10 statement. The firms handled about 80 percent of foreclosure cases in the state, according to a letter from U.S. Representative Alan Grayson, a Florida Democrat.

Judges overseeing foreclosures in the wake of the housing crisis are growing skeptical of banks, said Christopher L.
Peterson, a professor at the University of Utah’s S.J. Quinney College of Law. A surge in proceedings has helped expose a variety of paperwork lapses, he said in an interview.

“Early in the process the judges were very cavalier and they just took the financiers’ word,” Peterson said. “Now there are enough disputes out there about ownership of loans that the judges are starting to feel like they need to hold the financial institutions to the basic rules of evidence.”

dire as a result of this ruling, as this could severely impact the
ongoing attempt by banks to hide as much excess inventory in their books
in the quietest way possible." Jasraj also notes: "Using publicly available data from HUD and RealtyTrac, we have created a list of judicial foreclosure states. These are states where judicial foreclosures are most common and in which the lender has to appear before a judge and obtain a court order before initiating foreclosure proceedings against the delinquent borrower. Such states tend to have much longer foreclosure timelines than non-judicial states. What is striking about the list of states in the GMAC announcement is that all but one (North Carolina) are judicial states. Also, all judicial states in the country but one (Delaware) are in the GMAC list. This would hint at some potential issues with judicial states that is driving the GMAC directive." In the meantime, class actions lawyers across the country will not be sleeping for days.

Further action has also been frozen on all properties for which foreclosure has already been implemented. Any buyers of those properties face an extension of the closing date by 30 days and have the option to cancel the agreement to purchase.

Most likely an issue with judicial states

Using publicly available data from HUD and RealtyTrac, we have created a list of judicial foreclosure states. These are states where judicial foreclosures are most common and in which the lender has to appear before a judge and obtain a court order before initiating foreclosure proceedings against the delinquent borrower. Such states tend to have much longer foreclosure timelines than non-judicial states. What is striking about the list of states in the GMAC announcement is that all but one (North Carolina) are judicial states. Also, all judicial states in the country but one (Delaware) are in the GMAC list. This would hint at some potential issues with judicial states that is driving the GMAC directive.

A recent news report provided some hints at the type of issues with judicial foreclosures that servicers may look to avoid before it become a larger issue. The Florida Attorney General recently announced an investigation of the three largest foreclosure law firms in the state. These firms represent the lenders, and there have been question about claims of note ownership put forth by these firms during foreclosure proceedings. A clean record of note ownership is lost or hazy in many cases, due to multiple transfers of the notes. The moratorium can be an attempt on the part of RFC to ensure that the process does not have significant flaws that can leave it open to legal action in the future.

At this stage, we are unable to ascertain what that exact issue might be. What is certain is that foreclosure timelines in those states for GMAC loans will be extend further, potentially adversely affecting their eventual severity.

Can it also be a lawsuit in the making?

Given that the directive spans multiple states, and given previous experience with Countrywide, there is always the possibility of some multi-state settlement in the works for various disclosure issues with lending practices. However, we found some major omissions when we compared the list of states in the GMAC announcement with those involved in the Countrywide announcement. California, Nevada and Michigan - three states with significant mortgage volume, as well as distressed mortgages - are missing from the announcement. This makes us a little skeptical whether this is indeed a class action lawsuit in the making on the lines of the Countrywide one. On the other hand, the Countrywide list ballooned from 11 states initially to 42 states and DC finally, so one cannot yet rule out multi-state action. However, given greater evidence about judicial states, we still believe that to be the primary driver of this directive.

GMAC volumes in the non-agency securitized space

We used LoanPerformance to get a quick estimate of the volume of GMAC serviced loans in each of these states. Overall, we find that about 30% of the outstanding balance of GMAC-serviced loans falls within these 23 states. However, the share of delinquent loans within these states is higher: about 40% of GMAC delinquent loans falls within these states, with a higher concentration in alt-A and subprime.

Effect on housing

Implementation of this foreclosure moratorium, depending on its length and extent, could be a mild positive in the near term. A reduction in REO supply and foreclosure sales by GMAC would take out some distressed supply from the market. The effect of this announcement is similar to what we have earlier described for various loan modification efforts. It prevents more REOs from hitting the market and, thus, artificially skews the mix of distressed properties in the sales metrics. Reduction in the share of REO sales in overall sales has the effect of a stronger reading on the home price indices. However, this comes at the cost of a larger shadow inventory of non-performing loans, which continues to create pressure on home prices for an extended period.

Another significant departure from Yahoo: Steve Schultz (pictured here), who was GM of its important and powerful Yahoo Finance unit, has left the company to become COO of Pageonce, an online personal-finance “assistant.”


Yesterday, the editor-in-chief of Yahoo’s Shine women’s site, Brandon Holley, left Yahoo to run Lucky magazine for Condé Nast.


Also recently gone from Yahoo (YHOO): Social platforms head Neal Sample to eBay (EBAY) and Jason Titus, who ran its communications products unit and whose next job is unknown.


Schultz, though, is landing at a Palo Alto, Calif., start-up that has raised $8 million in venture funding. Pageonce collects online financial information and displays it on a unified and personalized page.


Schultz, who has been at Yahoo five years, was, according to his company bio, “responsible for business and content strategy and oversees business development, partnerships, marketing and sales. Prior to this role, Steve led product efforts in Yahoo!’s personalization products group, where he launched Yahoo!’s unified user profiling platform and managed personalization strategy and implementation efforts for Yahoo.com and My Yahoo!”


In the interests of fairness, BoomTown lobbed an email into PR at Yahoo tonight for the name of the person taking over for Schultz and also a list of major execs the Silicon Valley Internet giant is hiring.


Yahoo said no one has been named yet to replace Schultz.

Health and Human Services Secretary Kathleen Sebelius is just the latest creepy keeper of the Obamacare enemies list. Last August, the White House Office of Health Reform called on its ground troops to report on fellow citizens who talked smack about the Democratic plan. Team Obama issued an all-points bulletin on the taxpayer-funded White House website soliciting informant e-mails:

Then-health czar office spokeswoman Linda Douglass appeared in an accompanying video singling out conservative Internet powerhouse Matt Drudge. Why? Because his website featured a video compilation of Obama and other Democrats — in their own words — exposing the “public option” as a Trojan Horse for government-run health care and the elimination of private industry.


The Obama dog whistle rang out loud and clear: Report online dissidents immediately.


Calling on the White House to cease and desist, GOP Sen. John Cornyn pointed out that “these actions taken by your White House staff raise the specter of a data collection program. … I can only imagine the level of justifiable outrage had your predecessor asked Americans to forward e-mails critical of his policies to the White House.” The flagging operation was shut down, but a plethora of federal disclosure exemptions protect the Obama administration from revealing what was collected, who was targeted and what was done with the “fishy” database information.


In February, the White House coordinated a demonization campaign against Anthem Blue Cross in California for raising rates. Obama singled out the company in a “60 Minutes” interview, and Sebelius sent a nasty-gram demanding that Anthem “justify” its rate hikes to the federal government. A private company trying to survive in the marketplace was forced to “explain” itself to federal bureaucrats and career politicians who have never run a business (successful or otherwise) in their lives. Sebelius went even further. She called on Anthem to provide public disclosure on how the rate increases would be spent — a mandate that no other private companies must follow.


We already have a federal pay czar requiring companies to justify their pay raises and claiming authority to claw back bonuses already paid. Will the White House next demand that other businesses — not just health insurers — justify price increases deemed unreasonable, excessive or “extraordinary”?


On Capitol Hill, Democratic chief inquisitor Henry Waxman trained his sights on executives from Deere, Caterpillar, Verizon and AT&T in a brass-knuckled effort to silence companies speaking out about the cost implications and financial burdens of Obamacare. He scheduled an April 21 show trial of corporate heads who dutifully reported writedowns related to the Obamacare mandates. Obama Commerce Secretary Gary Locke joined in on the witch-hunt, pummeling the companies on the White House blog and TV airwaves for their “premature” and “irresponsible” disclosures.


After the Democrats’ own congressional staff pointed out that the companies “acted properly and in accordance with accounting standards” in submitting filings that were required by law, Waxman called off the hounds. But it was a temporary reprieve. Sebelius’ threat last week against individual market health insurers who raise rates to cope with new federal coverage mandates will be far from this desperate administration’s last.


As health costs skyrocket, doctors abandon the profession, hospitals lay off workers and private insurers shut down, the only way to quell the Obamacare backlash will be through an even more thuggish campaign to demonize, marginalize and silence nationwide dissent.

OK then. Well, happy trails. Colorado's Board of Regents voted Tuesday night to leave the Big 12 for the Pac-10 in 2011, ushering in the new Pac-12 a year earlier than expected. The move will only cost CU about $6.8 million in forfeited conference revenue, way less than the $9 million-$14.5 million figure that had been floating around, and the Pac-10 still plans to front the smaller figure to keep the cash-strapped university from dipping into state funds. Now: The mechanics of partitioning the expanded league into divisions, finalizing schedules and setting up a championship game can begin in earnest. [Boulder Daily Camera]



Big Ten-bound Nebraska also finalized its exit fee from the Big 12, which will amount to almost $9.3 million in withheld payments next year – less than half what the 'Huskers expect to take home on their first check from the Big Ten in 2012. In all, the $17 million tab from both outgoing members is about half of what the Big 12 initially sought when the announcement of their departures nearly ripped the league apart in June. A chip off the old block. Michigan State tight end Dion Sims was one of 10 people hit with felony charges Tuesday for receiving and concealing stolen laptops as part of a theft ring that allegedly lifted 104 computers from Detroit Public Schools last year for resale online. Sims was immediately suspended from the team and faces up to 10 years his prison. The other shoe: His father was already facing felony charges himself for allegedly embezzling money from the University of Michigan to buy $74,000 worth of computers over the last two years. With Brandon Wegher's ongoing leave of absence and veteran placeholder Paki O'Meara recovering from a concussion, coach Kirk Ferentz said the Hawkeye backfield behind quarterback Ricky Stanzi currently consists of sophomore Adam Robinson and "anybody else who wants to volunteer." Well, at least we finally made a decision. BYU's struggling two quarterback experiment is officially over after one half of the platoon, junior Riley Nelson, was ruled out for the rest of the season Tuesday with a lingering shoulder injury he originally suffered last year. Nelson started the Cougars' first three games, but yielded the final three quarters of Saturday's 34-10 loss at Florida State to true freshman Jake Heaps, who completed fewer than half his passes and was sacked six times. Fundraising is a key component for most social good campaigns and projects. Thanks to the the Internet and the social web, raising money for a non-profit, community project or charitable organization or relief effort is easier than ever before.

The web makes it possible to get your message across and collect money from people all over the world and to include your social graph in the process.

If you have an idea or a cause that you want to bring awareness to and raise funds around, there are lots of great online tools to help get you started. Whether you want to raise money for a local community center or help fundraise as part of a broader social good campaign, these tools make it easy to get the word out and collect the funds you need./> id="more-380180">

1. FirstGiving

The U.S. subsidiary of JustGiving.com, FirstGiving lets users raise money for any non-profit in the GuideStar database.

It’s free to create a basic account, but if you pay $300 you can fully customize your donations page and link them back to your own website. FirstGiving lets you create fundraising around upcoming events, marathons and walk-a-thons too, which is a nice touch. The processing fee for donation is 5% plus another 2% for credit card transactions.

2. Crowdrise

We mentioned Crowdrise in a recent post about alternatives to Facebook Causes and it is a great tool for both charities and general purpose fundraisers.

Once you start a project, you can share your project’s link via Facebookclass="blippr-nobr">Facebook, Twitterclass="blippr-nobr">Twitter and e-mail. You can also earn points from the community based on your project and your overall campaign. Crowdrise also has an ongoing series of promotions and sweepstakes that you can add to your project to sweeten the incentive to give.

3. Kickstarter

Kickstarter is most often used by aspiring creatives to fund projects but it can also be used for great effect for local social good community efforts.

Kickstarter is unique in that if your goal amount isn’t reached, none of the money is collected. This “all-or-nothing” approach often leads to Kickstarter campaigns being more active and more involved than a traditional “donate widget.”

A great part of Kickstarter for the social fund creator is the ability to reward donors at certain levels. Much like PBS and NPR offer trinkets if you give a certain amount, Kickstarter lets its project creators do the same thing. You can get really creative with your different donor levels to drive people to give more.

4. WhatGives

WhatGives offers a great widget you can use on Facebook or on your personal webpage to collect donations for your non-profit. WhatGives is nice because aside from integrating well with Facebook, all donations are handled through PayPal.

You need to be a registered non-profit with an approved PayPal account, and all donations are channeled directly into that account. You can customize the platform and embed it as a Facebook app or on your blog or website.

5. Change.org

Change.org lets users create programs to generate actions from others. This can be as simple as signing a petition or writing a letter, or as generous as donating money. For non-profits in the GuideStar database, you can create your own donation pages to collect funds and also draw attention to other action items.

Change.org is very focused on making it easy to virally spread a message, and the site itself also acts as a portal to different organizations and awareness campaigns.

6. Chipin

Chipin is one of the most popular donation widget tools on the web and it’s a great way to collect money for a good cause. We love the Chipin widget because you can see instant progress on donations, and it accepts many forms of payment.

Unlike many of the services on this list, Chipin isn’t just for non-profits or community organizations. You can use it for any project you want.

7. Razoo

Razoo has options for individuals, non-profits, foundations and corporations to raise money for their causes. Individuals can choose to create a fundraising page for any registered non-profit that Razoo recognizes (they have a database of about a million) and non-profits can create custom pages for their organizations and connect with supporters and encourage them to create their own fundraising pages.

What we love about Razoo, in addition to its simple interface and great UI, is that it also offers donation matching for corporations or foundations looking for an easy way to raise money.

8. Convio

Convio offers software for online fundraising and membership, and while its target audience is probably bigger groups or organizations, it’s still worth a look.

For example, Convio’s TeamRaiser lets organizations make it easy for volunteers to create their own websites for tracking and attracting donations.

If you’re organizing a social good fund for a big charity walk or event where volunteers go door-to-door to get donations, check out Convio because it makes managing that process much easier.

9. Facebook Causes

Causes is an increasingly common way for individuals to raise money and start their own funds that are tied to a non-profit. Because Causes is so well-integrated into Facebook, it makes getting the word out and raising awareness and funds for your cause that much simpler.

10. StayClassy

A newer player in the arena of online giving, San Diego’s StayClassy is focused not just on helping non-profits collect donations online, but also manage events and campaigns, track their fundraising results and plug-in.

The third wave of programming for the sixth edition of Fantastic Fest, happening September 23rd-30th in Austin, Texas, has been announced with the highlights being the US premiere of the hyper-stylized action film Bunraku, a sneak preview of Darren Bousman’s terrifying new horror-thriller Mother’s Day, and the world premiere of Agnosia, the latest film from Fantastic Fest 2005 alumnus Eugenio Mira.


A total of 20 films have been added in this latest wave, and we're including them all here, even if a few aren't strictly horror, just to give you an idea of how truly diverse Fantastic Fest is. For the other films screening that week, click here for all our Fantastic Fest 2010 coverage.



PREMIERE SCREENINGS


Agnosia (2010)

Director: Eugenio Mira, Spain, World Premiere

The producers of Pan’s Labyrinth and The Orphanage present a truly unique romantic thriller from Fantastic Fest veteran Eugenio Mira (The Birthday). “I’ve read few screenplays in my life that have impressed me as much as Agnosia,” said director Guillermo del Toro. Mother’s Day (2010)

The year is 1984. A rabid pack of rampaging punk teens run our schools, our drugs and our prostitutes. Brutality and decadence are everywhere. Enter first-year teacher Andrew Norris (Perry King), who’s forced to violently turn the tables on the bloodthirsty gang before their trashwave swallows the town alive. Writer/director Mark L. Lester’s reckless masterpiece debuted at Cannes Film Festival to severely divided reviews.


What detractors and many thrill-seeking fans both sadly overlooked was the fact that the movie had been done exactly right. Each actor turns in a memorable, convincing performance amid knifings and punk slam pits. Beloved ham Roddy McDowall pulls off what may have been his best scene of the decade. The film moves constantly forward at full speed, with humor and intelligent dialogue balancing out the horrors perpetrated by the vicious teens. Class of 1984 is a perfect exploitation film. It’s relentlessly seedy, overflowing with assault, suicide, racism, drug use and crime crime crime, all of which is perpetrated by minors! The tension of victimization and vengeance create some of the most stirring scenes of violent retribution on record. But beyond all this, there’s a bitterly absorbing air of human helplessness and leather-clad heartlessness that makes this movie the flat-out best in its genre.



Master Pancake Theater – Independence Day

During Fantastic Fest 6, the boys of Master pancake will be skewering the It’s A Mad Mad Mad Mad World of sci-fi disaster flicks. Featuring a massive cast of pretty good A-listers (Will Smith, Bill Pullman, Jeff Goldblum) and awesome B-listers (Judd Hirsch, Harry Connick Jr., and Brent "Data" Spiner) in the fight of their lives against a horde of invading aliens. Marc Savlov of the Austin Chronicle called ID4: "A gasping, bloated roller-coaster ride that veers from scenes of truly awesome destruction to stretches of numbingly bad melodrama and back again." The president himself, Bill Pullman, will be joining the Pancake team to mock the hell out of this bloated rollercoaster.

Mel Brooks' Star Wars parody is soooo much more than just a parody film, bursting with the sorts of jokes that the writers of all the recently-made and vastly inferior "spoof films" only wish they could dream up. • Cost the average non-farm small-business owner $3,500 more in taxes.

• Cost the 49% of all seniors with income below $250,000 $525 in additional dividend taxes.

• Cost the 25% all seniors with income below $250,000 $742 in higher taxes.

Now that's the kind of change you can feel in your nether regions!

Insider Selling Outpaces Buying By Over 290-To-1 In Past Week


...for the week ended September 17, corporate insiders bought $1.4MM in shares in a whopping 7 different companies. This was just marginally offset by sales of $441MM in 98 different companies, a ratio of 290 to 1 of stock notional sold to bought. But wait: this is GREAT NEWS: last week the ratio was 650 to 1! So this is a huge improvement and certainly yet another reason for today's rally... for those wondering just who is orchestrating today's move higher, please let us know if you find out.

It would appear that certain foreclosures by major, major institutions may have been fraudulent... and, thus, invalid, which could really, really screw things up


Ally Financial Inc.’s GMAC Mortgage unit told brokers and agents to halt evictions tied to foreclosures on homeowners in 23 states including Florida, Connecticut and New York...

...At least one (and perhaps more) "inside officers" in various law firms filed thousands (and maybe tens of thousands) of affidavits they did not read and thus could not have attested to.

...This practice appears to not be limited to one law firm. In fact, it may be basically the entire "foreclosure industry" that was involved in this.

...This is likely to derail many foreclosures - at least from a standpoint of time. It may also void some of them and force them to be re-litigated. This will have a SEVERE impact on loss severities - at minimum....

...If the time has passed to be able to make reasonable corrections to these so-called "ministerial errors" (and it probably has) then the impact on MBS holders who happen to have the "hot potato" in non-agency securitizations could be catastrophic...

In plain English, some reports indicate that thousands of foreclosures could have been performed without the appropriate documentation. Which could make them, ehm, invalid.

Which would make some of the investment vehicles derived thereof (like mortgage-backed securities or MBS), ehm, difficult to value.

• Destroy an average of 693,000 jobs every year through 2020.

• Drain $726 billion from disposable income, $38 billion from personal savings, and $33 billion from business investments.

• Raise taxes on the 55% of all joint filers earning more than $250,000 who run small businesses that employ others.

• Cost the average non-farm small-business owner $3,500 more in taxes.

• Cost the 49% of all seniors with income below $250,000 $525 in additional dividend taxes.

• Cost the 25% all seniors with income below $250,000 $742 in higher taxes.

Now that's the kind of change you can feel in your nether regions!

Insider Selling Outpaces Buying By Over 290-To-1 In Past Week


...for the week ended September 17, corporate insiders bought $1.4MM in shares in a whopping 7 different companies. This was just marginally offset by sales of $441MM in 98 different companies, a ratio of 290 to 1 of stock notional sold to bought. But wait: this is GREAT NEWS: last week the ratio was 650 to 1! So this is a huge improvement and certainly yet another reason for today's rally... for those wondering just who is orchestrating today's move higher, please let us know if you find out.

It would appear that certain foreclosures by major, major institutions may have been fraudulent... and, thus, invalid, which could really, really screw things up


Ally Financial Inc.’s GMAC Mortgage unit told brokers and agents to halt evictions tied to foreclosures on homeowners in 23 states including Florida, Connecticut and New York...

...At least one (and perhaps more) "inside officers" in various law firms filed thousands (and maybe tens of thousands) of affidavits they did not read and thus could not have attested to.

...This practice appears to not be limited to one law firm. In fact, it may be basically the entire "foreclosure industry" that was involved in this.

...This is likely to derail many foreclosures - at least from a standpoint of time. It may also void some of them and force them to be re-litigated. This will have a SEVERE impact on loss severities - at minimum....

...If the time has passed to be able to make reasonable corrections to these so-called "ministerial errors" (and it probably has) then the impact on MBS holders who happen to have the "hot potato" in non-agency securitizations could be catastrophic...

In plain English, some reports indicate that thousands of foreclosures could have been performed without the appropriate documentation. Which could make them, ehm, invalid.

Which would make some of the investment vehicles derived thereof (like mortgage-backed securities or MBS), ehm, difficult to value.
